Welcome to www.PUPPcares.org (the “Website”), made available by Partners United for People and Pets, Inc. (“PUPP”).  Thank you for taking the time to visit our Website! PUPP has created this privacy policy statement (the "Privacy Policy") in order to demonstrate our firm commitment to your privacy.  This policy discloses our information gathering, use and sharing practices (collectively, “Privacy Practices”). By using or accessing this Website, you signify your consent to our Privacy Practices.

We reserve the right, in our sole discretion, to modify this Privacy Policy at any time by posting such changes here.  Your continued use of the Website following the posting of any changes to this Privacy Policy indicates your acceptance of such changes.  If you do not agree to this privacy policy you are not authorized to access or otherwise use the Website.

In addition to a description of our Privacy Practices generally, this policy includes a description of the type of information we collect from you and how we use it, how we protect children 13 and younger, how you can opt-out of receiving communications from us, how we protect the security of your information and how to contact us with any comments or questions about this Privacy Policy.

A.    Information We Collect and How We Use It

In order to utilize some of the services that may be made available to you by the Website, we may ask you to provide and you may choose to provide, via a link from the Website to our third party vendor Constant Contact, Inc. (who utilizes SSL encryption technology to protect information it receives), certain personally identifiable information, including but not limited to, your name and email address ("Personal Information"). Personal Information is collected via voluntary submissions from you. If you do not want to provide us with your Personal Information, you do not have to!  Even if you do not provide us with any Personal Information, you may still access the Website but certain services may not be available to you. For example, if you do not provide us with your name and email address, we cannot add you to our E-newsletter distribution.

We may share your Personal Information with our technical consultants, third party auditors and other third parties who make the Website available, enhance its functionality or provide associated services.  Further, if you decide to make a donation to PUPP via the Website, we will not see your financial information.  The financial information you submit shall be sent directly to and processed only by PayPal which is TRUSTe certified.

By providing your Personal Information to PUPP through the Website, you consent to receive information and updates from us, our representatives or our authorized third party providers. We will not sell or rent your Personal Information to any unaffiliated third party, and except as set forth above with respect to our authorized third parties, or as required by law, we will not share your Personal Information with any third party.   You may, at any time, request to have your Personal Information deleted from our database by sending a request to: info@PUPPcares.org, Subject: Personal Information Removal.

In addition, we may also collect non-personally identifiable information, such as IP host address, pages viewed, search queries, impressions and other data, and may aggregate such information in any manner in our sole discretion which does not identify any individual ("Aggregate Information").  

We may use Aggregate Information to improve and enhance your experience on the Website and for our research activities. For example, we may share Aggregate Information with unaffiliated third parties in an aggregate, anonymous form, which means that the shared information will not contain nor identify any Personal Information.

B.    Cookies

"Cookies" are pieces of information that may be placed on your computer by the Website for the purpose of facilitating and enhancing your communication and interaction with that website. We have no intention of collecting personally identifiable information from children under the age of 13 unless we have first received parental or guardian consent.  Additionally, if you are 13 years old or younger, you are not authorized to submit any information to this Website unless you have received the explicit consent of your parent or legal guardian. D.    How to Opt-Out

You may opt-out of receiving email or other communications from us at any time by contacting us at: info@PUPPcares.org, Subject: Opt-Out, or by calling: 917.733.2170.  Please note that there might be a brief delay between when you submit your request to “opt-out” and when it is processed and reflected in our systems; accordingly you may continue to receive communications from us for a limited time after you unsubscribe.  We apologize for any inconvenience and appreciate your patience!

E.    Security

The security of your Personal Information is very important to us.  We attempt to provide for the secure transmission of your information from your computer to our servers by utilizing SSL encryption technology. We have put in place physical, electronic, and managerial procedures to safeguard the information we collect, however, due to the inherent open nature of the Internet, we cannot guarantee that communications between us will be free from unauthorized access by third parties.  Your use of the Website demonstrates your assumption of this risk. Except as otherwise required by law, only those individuals (at PUPP or one of our authorized vendors) who need access to your information in order to perform their duties are allowed access to your Personal Information.

This Privacy Policy and our legal obligations hereunder are subject to the laws of the state of New York and the U.S.A., regardless of your location.  You hereby consent to the exclusive jurisdiction of and venue in the federal and state courts located in New York, New York, U.S.A. in all disputes arising out of or relating to this Privacy Policy.

Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHEREVER TAXED, RESTRICTED, OR PROHIBITED.

This Sweepstakes is governed exclusively by the laws of the United States.  

1. How to Enter.  Eligible recipients of the PUPP mailing list who sign up to receive the PUPP mailing list between 12:01AM Eastern Time (“ET”) on March 11, 2009 and 11:59PM ET on May 31, 2009 and remain recipients of the PUPP Mailing list through 11:59PM ET on May 31, 2009each, a “Recipient”) are automatically entered into the The PUPPeNews Sign Up and Suds Up Giveaway sweepstakes (the “Sweepstakes”). To join the PUPP mailing list, visit www.PUPPcares.org and enter your email address in the sign up box provided.
 
Limit one (1) entry per person/email address, and each entrant may only enter on his or her own behalf.  Submitting more than one entry form or submitting an entry form on behalf of another person will void all entries by that potential entrant. No automated entry devices and/or programs permitted.  All entries become the sole and exclusive property of Partners United for People and Pets (“Sponsor”) and receipt of entries will not be acknowledged or returned.  Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic.  Only fully completed hand printed entry forms are eligible.  Proof of submission will not be deemed to be proof of receipt by Sponsor.  

2. Eligibility. Participation open only to intended Recipients who are legal residents of the New York Tri-State area and are 18 years of age or older as of the date of entry.  Void outside the New York Tri-State area, as well as where prohibited, taxed or restricted by law.  Entrants who opt to no longer receive the PUPP Mailing list on or before 11:59PM ET on May 31, 2009 are ineligible to participate in the Sweepstakes.  Employees, officers & directors of Sponsor, its advertising and promotion agencies and its parent companies, subsidiaries, affiliates, partners, dealers, manufacturers or distributors of sweepstakes materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter.  All federal, state and local laws and regulations apply.  

3. Random Drawing/Odds. One (1) winner (“Winner”) will be selected in a random drawing from all eligible entries received on or about June 1, 2009. By entering a Sweepstakes, entrants fully and unconditionally agree to be bound by these rules and the decisions of Sponsor, which will be final and binding in all matters relating to the Sweepstakes.

4. Prizes. One (1) winner will receive a gift certificate to Biscuits & Bath, a New York City-based dog daycare, grooming and training facility, good for one (1) dog bath and a comb-through.  Total approximate retail value: $75.00. No prize is transferable.  No substitutions or cash redemptions.  In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value.  

5. Notification. The Winner will be notified on or around June 1, 2009 by email. Following announcement of a selected Winner, such potential Winner will be required to sign and return, where legal, an Affidavit of Eligibility and Liability/Publicity Release within five days of prize notification. If a Winner cannot be contacted within five (5) calendar days of first notification attempt, if the Winner rejects his/her prize or in the event of noncompliance with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate Winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given.  Limit one prize per person/household/email address.

6. Conditions. All federal, state and local taxes are the sole responsibility of each Winner. Participation in a Sweepstakes and acceptance of prize constitutes Winner’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information and/or any statements made by each winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. By participating, entrants and Winner agree to release and hold harmless Sponsor, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.  Entrants who do not comply with these Official Rules or attempt to interfere with the Sweepstakes in any way shall be disqualified.

7. Additional Terms. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor will select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes.  Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

8.  Use of Data.  Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy.  Please review the Sponsor’s privacy policy at www.PUPPcares.org/privacy_policy.  By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.  

9.   List of Winners. To obtain the name of the Winner of the Sweepstakes, send a self-addressed, stamped envelope by April 30, 2009 to: PUPP, Attn: Sweepstakes Winners, PO Box 333, New York, NY 10159.
